2. Service Agreements

All projects are subject to a formal written contract specifying:

  • Project timeline and milestones
  • Total cost and payment schedule
  • Materials and quality standards
  • Warranties and guarantees
  • Terms for changes and variations

Quotes and Estimates

  • Quote Validity: All quotes are valid for 30 days from the date of issue unless otherwise stated
  • Site Inspection: Quotes are based on information provided and may require on-site inspection for accuracy
  • Estimate Nature: Estimates are approximate and subject to change based on actual project conditions
  • Price Changes: Prices may be adjusted for unforeseen circumstances, material price fluctuations, or scope changes
  • Additional Costs: Extra charges may apply for services beyond the original scope of work

Payment Terms

1. Payment Schedule

Unless otherwise agreed in writing, payment terms typically follow this structure:

  • Deposit: 30-50% of total project cost upon contract signing
  • Progress Payments: Staged payments based on project milestones
  • Final Payment: Balance due upon project completion and inspection

2. Payment Methods

We accept payment via bank transfer, cheque, or other agreed methods. All payments must be received before work commences at each stage.

3. Late Payments

Late payments may incur interest charges and may result in work suspension until payment is received. We reserve the right to place a lien on the property for unpaid amounts.

Project Execution

1. Timelines

While we strive to meet all deadlines, project timelines may be affected by:

  • Weather conditions and natural events
  • Material availability and supply chain issues
  • Changes requested by the client
  • Unforeseen site conditions
  • Regulatory approvals and inspections
  • Force majeure events

2. Client Responsibilities

Clients are responsible for:

  • Providing accurate project information and specifications
  • Obtaining necessary permits and approvals
  • Ensuring site access and utilities availability
  • Making timely decisions on selections and changes
  • Maintaining insurance coverage for the property

3. Changes and Variations

Any changes to the original scope of work must be requested in writing and are subject to additional charges. Change orders will be provided with cost and timeline implications before implementation.

Warranties and Guarantees

  • Workmanship Warranty: We guarantee our workmanship for 12 months from project completion
  • Material Warranties: Materials are covered by manufacturer warranties which we pass on to clients
  • Structural Warranty: Structural work carries extended warranties as specified in the contract
  • Exclusions: Warranties do not cover damage from misuse, negligence, normal wear and tear, or unauthorized modifications
  • Warranty Claims: All warranty claims must be reported in writing within the warranty period

Liability and Insurance

1. Our Insurance

We maintain comprehensive insurance coverage including:

  • Public liability insurance
  • Professional indemnity insurance
  • Workers' compensation insurance
  • Equipment and materials insurance

2. Limitation of Liability

Our liability is limited to the contract value of the specific project. We are not liable for:

  • Consequential or indirect losses
  • Loss of profit or business interruption
  • Delays caused by factors beyond our control
  • Damage to existing structures not part of the project scope
  • Third-party claims unrelated to our work

Cancellation and Termination

1. Client Cancellation

Clients may cancel a project with written notice. Cancellation fees apply based on project stage:

  • Before work commences: Loss of deposit
  • During project execution: Payment for completed work plus 20% of remaining balance
  • Materials ordered: Full cost of materials must be paid

2. Company Termination

We reserve the right to terminate a contract if the client breaches terms, fails to make payments, or creates unsafe or unworkable conditions.

Intellectual Property

All designs, plans, drawings, and specifications created by Carlusher's Construction remain our intellectual property unless otherwise agreed in writing. Clients receive a license to use these materials for the specific project only.

Website content, logos, branding, and marketing materials are protected by copyright and may not be reproduced without permission.

Dispute Resolution

In the event of a dispute:

  1. Parties will attempt to resolve the matter through good faith negotiation
  2. If unresolved, disputes may be referred to mediation
  3. Arbitration may be pursued if mediation fails
  4. Legal action may be taken as a last resort

These Terms are governed by the laws of Ghana and the United Kingdom, depending on project location.

Website Use

When using our website, you agree to:

  • Provide accurate and truthful information
  • Not engage in unauthorized access or hacking attempts
  • Not transmit malicious code or spam
  • Not use our website for illegal or fraudulent purposes
